1. GENERAL CONDITIONS

1.9. By registering on the site, the Buyer undertakes to use the correct services and site services, as well as obligations to pay and accept the order. The Seller, in turn, undertakes to fulfill its obligations to provide services, as well as to deliver and transfer the Buyer's ownership of the paid goods under the terms of this Agreement.

2. PRODUCT INFORMATION

2.1. All information about the goods is posted on the website and provided by the Seller.

2.4. For knitted products, a slight error in the width and length of the product is allowed due to the specifics of the production process.

 

2.4. The price for each item is indicated on the website of the online store in Russian rubles.

The website also lists prices in dollars and euros. These prices are indicative and depend on the exchange rate on the day of purchase and on the exchange rate of the customer's bank.

For an accurate calculation of the purchase price, the Buyer must himself convert the price indicated on the website in rubles into local currency.

 

2.5. The cost of goods on the site does not include the cost of customs duties and taxes

for countries in which their payment is provided when sending goods from Russia.

 

2.6. The seller has the right to change the price without prior notice to the product. However, the Seller is not entitled to change the price of the ordered product in the sales order after the order is received by the Seller.

3. PLACEMENT OF ORDER

3.1. The buyer agrees to provide the following information when placing an order:

3.3. If the Seller needs additional information, he can request it from the Buyer. If the Buyer does not provide information, the Seller is not responsible for the selected product.

 

3.4. The Seller is not responsible for non-fulfillment of the order (or delay in fulfillment) due to inaccurate or incorrect information provided by the Buyer.

4. CHECKING ORDER

4.1. The order is placed on the website by the Buyer.

 

4.2. The buyer can order goods through the website 24 hours a day.

 

4.3. By placing an order on its own, the Buyer agrees to transfer his personal information to the Seller and agrees to its processing by the Seller (as provided in Section 11), as well as the processing of information regarding the order or orders. 4.7. The purchase and sale agreement between the Seller and the Buyer is considered concluded from the date of issuance of a receipt for payment or other document by the Seller confirming payment for the goods by the Buyer.

5. ACCEPTANCE OF ORDER

5.1. After placing an order, the Buyer receives information (to the specified email address) about the details of his order, including the price of goods, delivery charges and other service charges (if these services are to be paid). The seller informs the buyer about the details of the order only via e-mail onlinestore@9aconcept.com.

 

5.2. Orders placed on weekdays from Monday to Friday from 09:00 to 18:00 Moscow time are processed within 24 hours. Orders placed on weekends and holidays are processed on the first business day following the holiday or weekend.

 

5.3. The order is considered accepted for execution after the Buyer receives an e-mail to the e-mail address specified in the registration form, confirming the acceptance of the order and / or after a message indicating the order number that appears on the website page.

 

5.4. The Seller reserves the right to cancel the Buyer's order at the stage of order confirmation.

 

5.5. The Seller reserves the right to agree on the details of the order with the Buyer by e-mail and phone. If it is impossible to contact the Buyer within 3 (three) days, the Order is canceled. If the Buyer has already paid for the order, the Seller must return the money using the same payment (bank) details with which the payment was made.

 

5.6. After placing an order, the Buyer receives information about the availability of the ordered goods in the Seller's warehouse.

 

5.7. In the absence of the ordered goods in the Seller's warehouse, the Seller contacts the Buyer in the ways specified in the order. The Buyer informs the Seller about his consent to accept the goods in the quantity available in the Seller's warehouse or about canceling the order completely. If it is impossible to contact the Buyer or the Buyer does not receive a response within 2 (Two) days from the date of the Buyer's notification, the order is canceled by the Seller in full. The Seller informs the Buyer by sending an email to the address provided during registration. If the Buyer makes an advance payment, the funds are returned by the Seller to the same payment (bank) details from which the payment was made.

 

5.8. If the product is in stock, the package will be sent to the Buyer within 1-2 business days.

If the Buyer has made a preliminary order for the goods, the package will be sent within 1-2 business days from the moment the goods arrive at the warehouse. The date of receipt of the goods at the warehouse is indicated in the conditions of pre-order in the description of the goods

If the Buyer has placed an order for several products, of which at least one of them is in the preliminary order, then the parcel will be sent to the Buyer when the pre-ordered product arrives at the warehouse.

6. TERMS OF PAYMENT

6.1. The price of the goods does not include customs duties and taxes for countries in which their payment is provided for when sending goods from Russia. The buyer is solely responsible for their payment.

 

6.2. The seller has the right to change the price of the goods without prior notice. However, the Seller has no right to change the price of the ordered goods in the Buyer's order after the order has been accepted by the Seller in accordance with clause 5.3. of these Terms.

 

6.3. The price of the goods is paid in Russian rubles.

 

6.4. We accept the following payment methods:

- by credit card - all payments are processed by Sberbank and are fully protected;

- through the Buyer's PayPal account.

 

6.5. When paying for an order with a credit card, the Buyer undertakes (at the Seller's request) to provide a copy of two pages of the credit card holder's passport with a photo and a copy of the credit card on both sides (indicating the last four digits) in accordance with the rules of international payment systems in order to verify the identity of the owner and his rights to use the card.

 

6.6. The Seller reserves the right to cancel an order paid by a credit card without giving any reason, in particular if the Buyer refuses to provide the necessary information provided for in clause 6.5 (by email in the form of scanned copies), including if there are doubts about their authenticity , within 14 days from the date of order. The order value will be returned to the cardholder.

7. FULFILLMENT OF THE ORDER AND ITS DELIVERY.

7.1. The delivery address is indicated when ordering the goods. The Seller is not responsible for incorrect delivery / order conditions if the Buyer provided incorrect information.

 

7.2. Delivery terms include order processing and delivery times.

 

7.3. The seller delivers orders by courier service DHL and CDEK. Delivery terms are indicated in the "Delivery" section on the website.

The buyer is obliged to accept the order within the agreed delivery time.

The delivered goods are transferred to the Buyer, and in his absence - to any person who presented the order confirmation or any document confirming the registration of the delivery of the goods.

 

7.4. In order to avoid fraud, the courier service has the right to request your identity document, order number and tracking number. We guarantee the confidentiality and protection of the recipient's personal data.

 

7.5. The buyer undertakes to check the order upon delivery to ensure that there is no visible damage. If there are visible signs of damage, the Buyer must refuse to receive the parcel from the courier service and immediately contact the Seller.

 

7.6. If the order was lost during delivery due to an error in the delivery service, the Buyer will receive a full refund of the order and delivery costs after receiving a letter from the courier service confirming the absence of the package.

 

7.7. Product information is described in the technical documentation accompanying the product, on labels, markings or other means for certain types of products.

 

7.8. The website contains approximate delivery times. The Seller is not responsible for any delays due to unforeseen circumstances that did not occur through the Seller's fault and which could not have been foreseen.

 

7.9. The buyer has the right to refuse all ordered goods or individual items (if the order was not sent for delivery to the courier service) at any time before it is handed over to the courier service (before the signing of shipping documents). Cancellation of the order is made only on the basis of a written application from the Buyer sent by e-mail to return@thebazilika.com.

 

7.10. Any import duties and taxes, for the countries in which they are stipulated, are the responsibility of the recipient and will be collected at time of delivery. These fees are not included in the total amount at checkout. They are determined by the customs of the country of destination and are not under the control of the Seller.

 

7.11. For international orders, the package will be sent together with an official commercial invoice (invoice). Russian orders are delivered by courier service, whose powers include only the transfer of goods to the Buyer without paper receipts. For buyers from Russia, a cashier's receipt is provided through the fiscal data operator (OFD) in electronic form to the subscriber number or e-mail address specified by the Buyer when placing an order before making payments, in accordance with clause 5 of Art. 1.2 of Law 54-FZ.

 

7.12. For international orders: in case of late receipt of the order, DHL office may charge an additional fee for each day the parcel is stored.

8. EXCHANGE, REFUND, ORDER CANCEL

For countries that provide for duty-free import of goods, including the Russian Federation, the EAEU countries, exchange and return of goods of good quality is possible at any time before the delivery of the goods and within 7 calendar days after the initial delivery of the goods.

For countries in which the payment of import duties is provided, the exchange and return of goods of good quality is possible at any time before the transfer of the goods to the courier service (before the signing of the shipping documents) and within 7 calendar days after the initial delivery of the goods.

The application (form) for the return of goods is completed by the Buyer within 5 days from the date of initial delivery.

Exchange and return of goods of good quality are possible only if the specified goods were not in use, have retained their presentation, consumer properties, seals, factory labels and original packaging.

In the event of a dispute about the reasons for defects or the fact of using the goods and maintaining its marketable condition, an independent examination of the goods must be carried out.

The Buyer has no right to refuse a product of good quality with its individual characteristics, if the specified product can only be used by the Buyer who purchased this product.

 

8.1. Cancellation of order for countries that require payment of import duties

 

The buyer has the right to refuse all ordered goods or individual items at any time before it is handed over to the courier service (before the signing of the shipping documents) and receive a full refund. Cancellation of the order is made only on the basis of a written application from the Buyer sent by e-mail to onlineshop@9aconcept.com.

 

If the Buyer refuses to receive the parcel, if it was handed over to the courier service in Russia and the shipping documents were signed, it will be returned to Russia, and the Buyer will need to pay for re-import services, which include: customs duties for re-import to Russian customs (30% of product prices), return shipping costs (€ 30) and DHL brokerage services for customs clearance (which are approximately € 100, the exact cost is calculated by DHL on a case-by-case basis).
 
If the Buyer refuses to pay the re-import duty, the parcel will be disposed of by the courier service without refunding the funds to the Buyer.
 
For Ukraine, the re-import of parcels is not possible due to the current political situation. If the Buyer does not receive the parcel, the parcel will be destroyed by the courier service without a refund.
 
If the Buyer does not receive the parcel within 10 days after the parcel arrives at the destination indicated by the Buyer when placing the order, and also if the Buyer does not respond to the Seller's letters within 10 days after the parcel arrives at the destination, the parcel will be disposed of by courier service without the Buyer receiving any monetary compensation from the Seller.
 
The seller cannot in any way influence the Rules of international trade and customs declaration established by the legislation between the Russian Federation and other countries.

 

8.2. Exchange

 

To exchange the product, the Buyer must return the product and place a new order on the website or contact support at onlineshop@9aconcept.com. In case of exchange of goods, the Buyer must pay for the re-delivery service and customs payments (customs payments except for countries: Russia, Belarus, Armenia, Kazakhstan, Kyrgyzstan).

 

8.3. Return

 

8.3.1. To register a return, the Buyer must fill out the form on the website in the "Return" section no later than 5 calendar days from the date of receipt of the original parcel.

 

8.3.2. If the Buyer did not apply for a return and sent the parcel back to the seller without the Buyer's paper-filled return application and the completed return form on the Seller's website, the returned parcel will not be accepted and will be sent to the Buyer again, and no refund will be made.

 

8.3.3. The return package must be sent by the Buyer no later than 7 calendar days from the date of receipt of the original package. If the return package is sent 7 days after the receipt of the original package, the return procedure will not be possible, the Seller will not technically be able to make a refund, and the package will be returned to the Buyer.

 

8.3.4. Customs duties, sales taxes, shipping charges, and return shipping charges are not refundable.

 

8.3.5. To return goods of good quality (including due to their exchange), the Buyer undertakes to carefully package the goods (along with all accessories and a full set of accessories specified in the technical documentation of the goods) and attach the following documents:

9.1. An inadequate product is a product that has defects and cannot provide its functional qualities.

 

9.2. The return of goods of inadequate quality is made only on the basis of an examination.

The seller independently examines manufacturing defects within 3 working days.

In the event of a disagreement about manufacturing defects, the Buyer sends a claim to the email address onlineshop@9aconcept.com with a request for an independent examination and with confirmation that he is ready to pay the cost of the examination and the corresponding transportation costs. The Seller informs the Buyer of the cost of an independent examination and the amount of transportation costs prior to the corresponding examination. After that, the Buyer has the right to agree to an independent examination by the Seller or independently conduct an independent examination in official expert organizations and send an official expert opinion by courier service to the seller.

 

If the examination confirms the presence of a manufacturing defect, the Seller will exchange the goods or refund the money in full, including the costs of transportation and an independent examination.

 

9.3. If the delivered Order turns out to be of inadequate quality due to manufacturing defects or damage during transportation, the Buyer has the right to return or exchange it for a similar product of good quality, provided that it is in stock.

10. MONEY REFUND

10.1. The Seller refunds the money to the Buyer after receiving and inspecting the returned item in accordance with the return policy within 3 business days. The term for crediting funds to the Buyer's account depends on the terms established by the internal rules of the receiving bank.

 

10.2. The seller does not influence and is not responsible for the timing of crediting funds.

 

10.3. Refunds are made only to the same bank card or PayPal account with which the order was paid.

 

10.4. For international returns: due to different exchange rates on the date of purchase and the date of return, the refund amount credited to the buyer's account from the seller may differ from the amount paid by the buyer.

11. CONFIDENTIALITY AND PROTECTION OF PERSONAL DATA OF BUYERS

11.1.
